Introduction
These Terms of Use written on this webpage shall manage your use of the DancesSportingGoods.com (the “Site”) Website. These Terms will be applied fully, and affect to your use of the Site. By using the Site, you agree to accept all terms and conditions expressed here. You must not use the Site if you disagree with any of these Terms of Use. It is advised that you read the entire Terms of Use below before using the Site. The terms “Dance’s,” “Dance’s Sporting Goods,” “we,” “us,” or “our” shall refer to Dance’s Sporting Goods, Inc. The terms “you,” “your,” or “yours” shall refer to those using or accessing the Site as well as those intending to make purchases.
Minors
We do not conduct business with minors. We do not provide services or sell products to minors or others below the age of 18. Minors or people below 18 years of age are not allowed to use the Site.
Restrictions
You are specifically restricted from all of the following
• Publishing any material from the Site in any other media or Websites;
• Selling, sublicensing and/or otherwise commercializing any of the Site’s material;
• Publicly performing and/or showing any the Site’s material;
• Using the Site in any way that is or may be damaging to the Site or Dance’s;
• Using the Site in any way that impacts user access to the Site;
• Using the Site contrary to applicable laws and regulations, or in any way may cause harm to the Site, or to any person or business entity;
• Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to the Site without expressed permission from Dance’s;
• Using the Site to engage in any advertising or marketing.
• Certain areas of the Site are restricted from being accessed by you and Dance's Sporting Goods may further restrict access by you to any areas of the Site, at any time, in absolute discretion. Any user ID and password you may have for the Site are confidential and you must maintain confidentiality as well.
Store Policy
You are specifically required to abide by all of the following:
• All tactical-style rifles including but not limited to AR-10s, AR-15s, AK-47s, and bullpup semi auto rifles may not be sold to anyone under the age of 21.
• When purchasing a firearm, the Billing & Shipping addressees MUST MATCH. The names for Billing & Shipping may not be two different parties. Any order placed with mismatched names will be cancelled and refunded.
• If having a firearm shipped to a state where the magazine capacity exceeds state or local law, you agree to forfeit the magazines above the legal capacity. Dance's Sporting Goods will not supply magazines that meet the legal capacity. The ONLY exceptions to this rule are as follows:
- The receiving FFL dealer has communicated to us that they will accept the high capacity magazines and convert them to the legal capacity.
- The purchaser of the firearm is a law enforcement officer and has provided proper ID and a statement on department letterhead that the firearm is for duty use.
- The purchaser of the firearm is an FFL holder.
Your Content
In these Terms of Use, “Your Content” shall mean any audio, video, text, images or other material you choose to display on the Site. By displaying Your Content, you grant Dance's Sporting Goods a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.
Your Content must be your own and must not be invading any third-party’s rights including intellectual property rights. Dance's Sporting Goods reserves the right to remove any of Your Content from the Site at any time without notice.
Purchasing & Inventory
By purchasing products and items on the Site, you acknowledge that under rare circumstances, the product you have purchased may have been inadvertently sold in-store. In such instances, you will be refunded entirely or given store credit as soon as possible. By purchasing products and items on the Site, you also acknowledge that our inventory may falsely be reporting an item in-stock without our knowledge. This is a rare occurrence, and you will be refunded entirely or given store credit. In such cases, we deeply apologize. We truly try our best to keep all inventory up-to-date as often as possible. Such cases are more likely to happen on weekends, nights, and holidays when the Internet Sales team is not in the office. Dance's Sporting Goods does not accept order that are shipped or billed internationally.
In-Store Pickup
All orders marked for FREE In-Store Pickup should be picked up within 30 days of purchase. Orders not picked up within 30 days may be refunded and canceled and may be subject to a restocking fee of 20%. Orders accidentally marked as FREE In-Store Pickup that are needed to be shipped must pay for the appropriate shipping & handling charges prior to being shipped.
Description & Images
Dance's Sporting Goods has, to the best of our knowledge, listed all images, titles and descriptions as accurately as possible to represent each product we sell. Please note that we are not the product's manufacturers and some images, titles and descriptions may vary slightly from the actual product. Please contact the product manufacturer or visit their website to verify any images, titles or descriptions.
No warranties
The Site is provided “as is,” with all faults, and Dance's Sporting Goods expresses no representations or warranties, of any kind related to the Site or the materials contained on the Site. Also, nothing contained on the Site shall be interpreted as advising you. Any warranties listed on the Site pertain to the product manufacturers ad not Dance’s Sporting Goods. Please check with the manufacturer for return, repair, or replacement under warranty conditions.
Limitation of liability
In no event shall Dance's Sporting Goods, nor any of its officers, directors or employees, be held liable for anything arising out of or in any way connected with your use of the Site whether such liability is under contract. Dance's Sporting Goods, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of the Site.
Indemnification
You hereby indemnify to the fullest extent Dance's Sporting Goods from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions in these Terms of Use.
Severability
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
Variation of Terms
Dance's Sporting Goods is permitted to revise these Terms of Use at any time as it sees fit, and by using the Site you are expected to review these Terms of Use on a regular basis. Please see the date at the bottom of the page for the latest update information.
Assignment
Dance's Sporting Goods is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms of Use without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms of Use.
Entire Agreement
These Terms of Use constitute the entire agreement between Dance's Sporting Goods and you in relation to your use of the Site, and supersede all prior agreements and understandings.
Governing Law & Jurisdiction
These Terms of Use will be governed by and interpreted in accordance with the laws of the State of Virginia, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Virginia for the resolution of any disputes.
Proposition 65 - California Residents
Unfortunately, in compliance with Proposition 65, we can no longer sell or ship to California. California residents shall not make purchases on the Site. Any purchases made by California residents are not in accordance to the Site's Terms of Use and the buyer assumes all risk.
Intellectual Property Rights
Other than the content you own, under these Terms of Use, Dance's Sporting Goods and/or its licensors own all the intellectual property rights and materials contained in the Site including images and logos.
Limits
By completing a purchase with Dance's Sporting Goods you agree that you will abide by limits set on the product page and cart. If for instance an item is limited to a specific quantity, you understand that limit is per customer per day unless otherwise stated.
Shipping & Returns
By making a purchase on this site, you agree that you have read and agreed to our Shipping & Returns terms stated HERE.
Refunds
Refunds generally take 5-7 business days to post to your account. Some banks are faster to release funds than others, but 5-7 business days is the average we have seen.
You are granted limited license only for purposes of viewing the material contained on the Site.
